For many Americans, Labor Day simply signifies the end of summer, beginning of the school year or is viewed as a day off from work. For those of us involved in organized labor, it means more. However, and whenever you are able to celebrate Labor Day, I ask that you take time to educate those around you of how this country’s labor movement impacted the working conditions for EVERYONE in this nation. 

What this holiday is emblematic of is the celebration of the core values of SMART-TD and all Americans who built this country’s blue-collar middle class. The contributions of the labor community keep that dream alive in this country today. Labor Day is a chance to reflect on the achievements of our predecessors whose efforts provided the pathway to lives where the work you are willing to do ideally reflects your quality of life. With that in mind, we ask that you and your family recognize that the fight is never over and intensify your support for those engaged in labor fights.

Today has been made better by the men and women who came before us. It’s a disservice if we take the inroads they made for granted. This holiday weekend, I ask that we commit as union brothers and sisters to do two things. 

First, we should reflect on these men and women who fought before and are fighting now. It strengthens this union and labor as a whole when we take the time to learn about labor history. Perspective is a powerful tool. The collective power of union solidarity is as important to our lives today as it was to workers in the 1800s. The stands we make against the greed of management are the same fights that have gone on for hundreds of years.

Second, this weekend is an opportunity for us engaged in the struggle to take inventory of whether our commitment to our union is proportionate to what those who laid the groundwork before us have done. Child labor laws, minimum wages, the sanctity of healthcare being part of the compensation for our labor WERE NOT GIVEN TO US. Blood was spilled to make these things possible. 

Paying monthly dues provide membership in a union, but getting involved and living as good stewards of this legacy is what ignites and creates a community. These communities are what establish world-changing action.  

 Will you join the fight? Your union and our country need your voice and your talents. We are facing a large-scale resurgence of class warfare that threatens to erase the historic gains and protections the labor movement has earned. 

The world we live in provides many challenges to all of us in the labor movement. We need every one of our proud members to be engaged in order to better the lives of all. Let us keep the trails that were blazed by our predecessors clear, open, and accessible to all.  Be sure that the path to prosperous working-class lives is not enveloped by greed and exploitation.

Local 200 chairperson, general chairperson and SLD’s combined efforts get opportunity for cut workers to remain in industry

E. Hunter Harrison has been dead since Dec. 16, 2017. His legacy known as Precision Scheduled Railroading (PSR) is still alive and kicking.  

Some of the railroads have said publicly that they are trying to steer away from PSR. But in an unexpected twist, the specter of Harrison is rearing its ugly head in the lives of all our Union Pacific members with the recent ascension of new CEO Jim Vena.   

Vena is a known student of Harrison. When UP employees, some stockholders and SMART-TD general chairpersons expressed alarm at Vena’s hiring, the carrier put out a well-polished piece of propaganda about how Vena 2.0 was a changed man. 

We were all supposed to be put at ease, that he had learned the hard way that PSR was an unnecessarily disruptive force to the industry, the supply chain and in the personal lives of railroad employees.  

For the record, SMART-TD never bought this idea. The five GCs of our UP General Committees in no uncertain terms informed the carrier that they strongly disagree with Vena’s hiring. In the letter sent to UP’s vice president of labor relations, our GCs said “As COO, Jim Vena enacted policies, practices, and procedures that deliberately destroyed our members’ quality of life for the sake of profit. 

“He orchestrated huge furloughs and cuts to every department in transportation, which resulted in the crew shortages we have yet to recover from,” the GCs wrote. 

This second point came into play almost immediately upon Vena taking over Aug. 14. Less than a week into his reign, Vena proved our GCs to be absolutely correct by announcing UP was going to cut 94 positions across four crafts and 13 terminals.  

These men and women whose jobs were erased through no fault of their own were represented by the IBEW, IAM, NCFO and SMART Mechanical Division. Many of these fellow railroaders worked in remote locations where the UP terminal was the largest employer. As a result, many of them were going to have to uproot their families and pursue new career opportunities. 

SMART-TD Local Chairperson Amanda Snide (Local 200, North Platte, Neb.) didn’t like what she was hearing. She was frustrated and confused why these railroaders, though from different crafts and unions, were being thrown to the wolves while her terminal was desperately looking to find candidates to fill their posted openings for conductor positions.  

Sister Snide took matters into her own hands at that point. She successfully brokered the idea with the local management at the North Platte terminal to offer 11 employees slated to be let go in the mechanical crafts positions as conductors.  

As we approach the Labor Day holiday, there can be no better example of the value of labor movement than what these three accomplished for these fellow railroaders and their families. We thank you for defending our rail labor brothers and sisters against the corporate greed that threatened everything they had worked to build.  

Snide’s results giving the workers affected by Vena’s malicious cuts at her home terminal the chance to preserve their income, health benefits and retirement, impressed Nebraska’s SLD Foust. He took what Snide had started and turned his attention to the 83 other casualties of Vena’s short-sighted greed. Foust contacted General Chairperson Luke Edington from GO-953. Brother Edington, who was already on the record with UP about not being on board with UP’s “new vision,” took it from there. 

Edington took Snide’s plan and Foust’s vision of expanding it straight to UP’s Human Resources Department. SMART-TD is very proud to announce that Brother Edington succeeded in reaching an agreement with UP that at all terminals where they are simultaneously attempting to hire conductors and laying off other craft employees will give the same opportunity to transfer to conductor positions that Snide had enacted in North Platte.  

As of Aug. 30, 50% of the affected employees in eligible terminals had applied for transfers to conductor positions — quite a few salvaged railroad careers.  

SMART-TD is very proud of the initiative taken by Sister Snide, SLD Foust and GO-953 GC Luke Edington to make this happen.  

As we approach the Labor Day holiday, there can be no better example of the value of labor movement than what these three accomplished for these fellow railroaders and their families. We thank you for defending our rail labor brothers and sisters against the corporate greed that threatened everything they had worked to build.  

There has always been and will always be Hunter Harrison and Jim Vena types in the rail industry. What is important is that we commit ourselves as a union and as individuals to make sure we can match them with the wits, fight, solidarity and humanity exhibited by members like Amanda Snide and that the union spirit embodies.

The term “getting railroaded” has its origins in the 1800s. Landowners would use it when the rail companies stole land in order to lay down new track. It has evolved these days to describe generally being cheated or bullied. Unfortunately, the originators of the term who perfected the practice are still bullying, but now it is focused on their own employees.

Today’s corporate railroads may not be stealing land, but they are stealing our jobs, our time and our safety. With Precision Scheduled Railroading (PSR), the number of railroad jobs has dropped 30%. Thousands of jobs were done away with even as we kept our country going through a pandemic. More were eliminated as the carrier executives chased an operating ratio that enriched the shareholders and railroad owners.

As headcount diminished, time was stolen as those still employed were forced to work more hours with new attendance policies that leave little time for family or rest. This led to a worker exodus that even further decreased employees and time.

This all resulted in workers’ safety being stolen. Pushing workers to the point of fatigue and making doctor’s appointments all but impossible to schedule have hurt workers’ health. Cutting inspection times and maintenance has led to more breakdowns and derailments. Growing train lengths have increased these dangers as well. In short, workers are all still getting railroaded.

So, what do we do about it?

Some have conceded that these companies and their lobbyists are too powerful. This mentality is understood, but we’ve seen challenges like these defeated before. Child labor, segregation and unsafe working conditions were all beaten back by unions. There’s no doubt that the odds seemed insurmountable at the time and yet they overcame them.

They did this because they had one big thing going for them. They were on the right side. Well, so are railroaders. In the last few years, we have seen customers, the public, news media and even politicians from both parties start talking about the dangers of PSR and one-person rail crews. Five years ago, it was ridiculous to think that major media outlets would have reports on these issues or even be concerned about, but they have and they are and progress is being made.

This happened because railroaders spoke out. They wrote emails, met with representatives and even used social media to spread the word. If all of us, together, made an effort to do the same, we could win this battle.

So, please use the resources that are available — take some time and write an email to your representative. Talk with leaders at a City Council meeting. Make some handouts and pin them on a board. Go to a union meeting and suggest something to inform your community. Do some philanthropy and talk about railroad issues. Put up an informative table at a festival. Do something to fight back. It’s hard to quiet 100,000 voices ringing. Every person who learns about this corporate greed and corruption is another crack in their armor. It’s easy to give up, but let’s stand strong together and let them know that the days of getting “railroaded” are now over.

In today’s age of economics driven by corporate greed, there are many trade unions in our country at odds with the so-called “captains” of their industries and the profit-obsessed mindset of upper management. Few unions, however, share such similar struggles as the members of the SMART Transportation Division and those that represent airline crews.

Currently, as our freight rail members await the results of an FRA ruling on the sanctity of the two-person crew in the locomotive cab, the Air Line Pilots Association, International (ALPA) is defending that exact same safety measure in the air. As flight crews cope with an epidemic of aggressive and often-violent behavior, our commuter rail and bus members are right there with them fighting that same battle on the nation’s roads and rails.

In light of these parallels, SMART-TD would like to state with clarity that we support ALPA in their efforts to legislate a two-pilot flight crew. Just as with our rail members, task overload, menu diving into screens/gauges, as well as fatigue are common distractions for pilots and impede safe operations. SMART-TD members know that reality all too well. We also know that redundancy and the second pair of eyes of an experienced fellow crew member are far better for safety than any computer software Silicon Valley can sell our industries on as they look to cut headcount and costs.

On Monday, January 16th ALPA is celebrating the 14-year anniversary of the “Miracle on the Hudson” when the highly skilled crew of Capt. Chesley “Sully” Sullenberger and F/O Jeffrey Skiles worked together to save the lives of 155 passengers and the crew of Flight 1549 famously taking the plane with two dead engines to a safe and heroic landing on the Hudson River.

As our brothers and sisters in ALPA make their arguments to the FAA regarding the vital importance of having two trained pilots in the cockpit during the agency’s reauthorization, we need to be on the right side of this fight. Corporate and shareholder profits must not be allowed to be placed above the safety in either the airline or freight rail industries.

SMART-TD commemorates the actions of that two-person crew on that cold January day in 2009 and stands in absolute and unyielding support of ALPA’s efforts in keeping two pilots in America’s cockpits.

Efforts of the airline industry to lobby Congress to amend part 121 of the Federal Aviation Regulations to allow single-pilot crews are dangerous, short-sighted and would threaten to disrupt the current period of safe operations by the air carriers in our nation. We encourage our members to contact their congressional representatives and tell them to not entertain the thought of disobeying airlines’ Rule of 2.

This is a call to action. The burning wreckage of what used to be the Grand Old Party (GOP) is attempting to attack the labor movement immediately after the holidays while our guard is down and as the transition to the new Congress occurs. SMART is asking you to take action and contact your congressional representatives before this underhanded measure succeeds.

Last spring, the staff workers for the U.S. Congress made the bold decision to organize into the Congressional Workers Union. This union represents those brothers and sisters who put themselves on the line for us with every bill that affects the lives of working people and of those who depend on us to make our living.

It should go without saying that this new and vastly important labor organization is worthy of our support and that of the people in our country; however, they are currently in danger of being legislated out of existence by their own bosses.

A more-classic example of union busting would be hard for any writer to conjure up. The newly minted Republican leadership of the U.S. House has yet to settle on the most basic of agenda items, including who will lead them as speaker. On that topic there are many varying Republican opinions, but there is one topic the fractured GOP can coalesce around, and that is trying to bust the union their direct employees have organized.

As the first order of business of the 118th United States Congress, the GOP majority’s priority could have been many things — perhaps addressing the war in Ukraine, inflation or the multitude of issues surrounding immigration. But, predictably, these issues are not nearly as threatening to those who hold power as the idea of their own workers organizing, so they are attempting to stomp that fire out with the very first legislation they’ll undertake, thus rolling back the advancement of congressional workers. In a House rules package that will likely be voted on today, Republicans have placed a repeal of House Resolution 1096 passed last year allowing Congressional staffers to unionize.

As this article stated in the beginning, it is the hope of the new “not sworn in yet” Republican majority to catch us asleep at the switch with this post-holiday surprise. They are hoping to put their boot on the necks of their staff without us noticing or calling them out.

This is where you come in.

SMART is requesting you let your voice be heard. These staffers who make up the rank-and-file membership of the Congressional Workers Union stood with us when the terms of our national rail contract entered the arena of congressional gamesmanship late last year. They stood with us (and still do) in our efforts to secure the dignity of paid sick leave. They take our calls daily and add volume to our collective voice when we need federal intervention in our day-to-day lives. Now it is our turn to help protect this newly formed union. Their own bosses are trying to rip a budding union out of the ground before it has a chance to root. We cannot allow that to happen and stand by in silence.

With a thousand things to do today as we collectively dig out from under our holiday distractions and obligations, let us make (and keep) a worthwhile New Year’s resolution by being an active union brother/sister in 2023 and an active/conscientious citizen right out of the gate.

Local 313 (Grand Rapids, Mich.) member Chris Larson, a member of our union for seven years, wrote to the office of SMART-TD President Jeremy Ferguson asking the extent that members can go to support and show solidarity to an ongoing labor action by another labor union against an employer.
More than 1,000 members of the Bakery, Confectionery, Tobacco Workers and Grain Millers (BCTGM) union have been striking for more than a month in locations in Portland, Ore.; Richmond, Va.; Norcross, Ga., and Chicago against Nabisco/Mondelez. Brother Larson suggested in a letter that unionized train operators stop deliveries to the company’s plants in a concerted effort in support of the strikes.
“Nabisco / Mondelz (sic) International will quickly notice when their raw inputs of flour, sugar, and other bulk commodities delivered by rail are no longer being delivered because SMART-TD is supporting the BCTGM strike,” Larson wrote. “I would like to encourage SMART-TD to quickly explore how our union can honor the BCTGM strike by not delivering raw inputs to Nabisco / Mondelz (sic) International by rail.”
While a strong and impactful suggestion by Larson, the federal Railway Labor Act limits when, where and why rail workers can engage in a work stoppage, as the union’s response noted.
“…it is important to note that the governing federal law (specifically the Railway Labor Act, as amended,) limits our ability to go on strike to very narrow and specific circumstances. Unfortunately, those circumstances do not include the secondary strike action you describe in your letter,” the TD office replied.
“We absolutely support the BCTGM workers in their fight for fairness and justice with Nabisco/Mondelez,” Ferguson said. “Our members and leadership will do what we can within the law through personal boycotts and outreach initiated by local members to show support from our union. We thank Brother Larson for speaking up and asking this question, and we appreciate his desire to act in solidarity with our fellow workers at BCTGM.”
Constitutionally, members can act in the interest of their personal safety in areas where a strike is taking place. According to Article 21B, Section 92 of the SMART Constitution:
When a strike of any other nationally recognized labor organization is in effect and danger to the safety of our members exists in or about the area affected by the strike, and/or if there exists any substantial present or potential threat of danger to the members enroute to or from their work, and/or to the members’ families, it is the policy of SMART to support its members in declining to enter the territory directly affected.
The strikes against Nabisco/Mondelez first began in August with BCTGM workers in Portland, then spread to the three additional locations during the month to protest the company’s outsourcing of U.S. jobs to plants in Mexico and the disproportionate hazard pay given to management when workers received only a $300 bonus.
As of this writing, the work stoppages are ongoing, and there are multiple ways TD members and their families can assist in the effort in the spirit of solidarity suggested at the BCTGM website.

The August 2021 Talking SMART episode focused on union mentorship, mutual support in the workplace, and working proactively to address issues such as hazing, bullying and discrimination. Our featured guests were SMART Director of Special Projects Louise Medina and SMART Local 265 member Mike Powers.

Every member has had at least one person in his or her career who has stood up for them, provided formal or informal union mentorship, or been there in times of crisis or need. SMART launched the I Got Your Back” campaign as a way to recognize those who have stepped up and stood up for what’s right and to reinforce a culture of paying it forward.

Sister Medina served as a business representative at Local 265 and president of the SMART Recruitment and Retention Council; in addition to director of special projects, she is also a member of the BE4ALL Committee. Brother Powers is also a Local 265 member who now serves as a trustee at his local. He began as an apprentice at Wiesbrook sheet metal and spent his apprenticeship and following journeyperson years learning all aspects of architectural and job management.  

In addition, General President Joseph Sellers joined Talking SMART for open mic segment at the end of the episode. He responded to a question about what SMART is doing to promote workplace environments that are free of bullying, harassment, hazing and discrimination.

SMART Transportation Division officers and attendees of the Association of General Chairpersons — District 1 conference stand together at the conclusion of the meeting on Oct. 3.

INDEPENDENCE, Ohio — Hours after a lawsuit by rail carriers targeting our union over crew consist was announced Oct. 3, the Association of General Chairpersons — District 1 unanimously resolved to act in solidarity.
The resolution states:
“In response to the Carriers’ attempts to undermine bargaining and divide us, we, the members of District 1, resolve to act in solidarity in every effort to protect our members and our rights under the Railway Labor Act.”
Every general chairperson in attendance signed the resolution as the meeting concluded.
Transportation Division President Jeremy Ferguson praised the leadership of the General Committees for a quick and unified response at the conclusion of the District 1 conference in the Cleveland area that also finalized the Section 6 notices that will trigger the beginning of the next round of National Rail Contract negotiations.
“As we progress forward into this negotiating period and beyond, solidarity among our membership at all levels everywhere will drive us as we overcome the challenges ahead,” Ferguson said. “This unanimous resolution shows at the outset that we stand together and will speak with one loud, clear voice.”
On Oct. 3, the National Railway Labor Conference (NRLC) filed a lawsuit in federal district court in the Northern District of Texas.
President Ferguson stated that this attempt to undermine our collective bargaining agreements was not unexpected.
“It is not the first time that carriers have attempted this tactic,” he said. “We are well prepared to respond.”

HOLLYWOOD, Fla. — Transportation Division President John Previsich looked to the recent past to point the way to the future on Monday, Aug. 6, at a critical point in United States labor history.
In opening remarks to the International Association of Sheet Metal, Air, Rail and Transportation Workers’ first combined educational meeting at the Hilton Diplomat Resort in Hollywood, Florida, Previsich reflected on the status of the coordinated bargaining unit’s national rail agreement talks that appeared to be at a standstill last summer and an appearance at the Sheet Metal Business Agents Conference in Vancouver last year that he said might have changed the tide.
At the time, a declaration of an impasse was likely at the next meeting between the rail labor unions and the carriers and a Presidential Emergency Board would convene, Previsich said.
But the potential impasse was broken at the next meeting with the carriers willing to negotiate, and Previsich has an inkling of what played a big part: unity.
“I told the Sheet Metal brothers and sisters in the room that when the time came, and that we had to look at a Presidential Emergency Board, I said I didn’t want 65,000 Transportation Division members calling the White House, I wanted 200,000 SMART members calling the White House,” Previsich said. “Every brother and sister stood up and pledged their support. I would like to think that support, that word, that message, got – maybe to the White House. It got somewhere good, because at the very next session immediately after that meeting in Vancouver, the railroads came into the room and started negotiating.”
Within a month, a contract offer was on the table that was ratified Dec. 1, 2017, by four out of five TD members, Previsich said.
“It was the support of everyone in that room that made that happen,” he said.
Establishing that unity not only within SMART but among all labor organizations nationwide and education efforts will be key in the aftermath of the attack on labor in the form of this summer’s Janus decision by the U.S. Supreme Court, Previsich said.
“There are forces out there that want to reset the entire playing field. They want to move the goalposts to a place that we can’t get to. They started with Janus,” he said.
The Janus decision nullifies the ability of public-sector unions to collect what are known as maintenance fees from “free-riders” — those people who take advantage of union membership benefits but do not pay for those benefits.
“It’s not going to be fatal to our organization, but it will be close to fatal to other organizations,” Previsich said.
Teachers unions, the SEIU and unions that protect government employees will be most affected, but that doesn’t mean that those anti-union forces will stop at just that single victory to crush labor in the U.S., he said.
“The next step is to private employers and there are already efforts to start that happening,” Previsich said. “They create a dispute here, a dispute there, get some conflicting court decisions and boom, it bubbles up to the Supreme Court.”
With a second Supreme Court vacancy to be filled by the Trump administration, 150 years of labor history that workers fought and died for is under attack and in jeopardy in the United States, Previsich said.
Union members need to act.
“We can no longer sit back and let somebody else take care of our business. We have to take care of it,” Previsich said. “We have to stand united, not only within, but with every other labor organization in the country. We need to talk to our friends, our relatives, our neighbors and everybody we encounter in the grocery store and let them know the labor movement is an honorable movement.
“It’s the foundation of America, and if they start beating back the unions, they’re going to beat back every employee in any form whether they’re unionized or not … we can’t let it happen.”
The key to stopping the attack will be individual action and spreading the word, member-to-member, about the importance of the November mid-term elections, Previsich said.
“This is really the cliff-side point in labor history. I can’t stress strongly enough how important it is that we get out there and motivate our members to get out there to preserve the labor movement,” he said. “We can’t forget our paychecks. We can’t forget our pensions, our benefits and our families.
“We need to make sure our members are educated on everything that is important to the cause, the movement, the preservation of the labor lifestyle that comes about as the result of unions and the hard work that they’ve been doing for 150 years.”
Earlier in the opening session, SMART General President Joseph Sellers Jr. and General Secretary-Treasurer Rich McClees also encouraged the further development of solidarity by increasing cooperation between the Sheet Metal and Transportation Division membership.
The Hollywood, Fla., combined educational meeting itself marks the first time since the Sheet Metal and Transportation Division’s merger that both a TD regional meeting and a Sheet Metal business agents conference have taken place at the same location.

Local UTU officers sacrifice much of their personal time, without compensation, to assist and serve their memberships, and they deserve recognition for their outstanding commitment.

That is what I intend to do in this month’s column.

Two such individuals deserving of recognition for their hard work and dedication are Lonnie Hookfin, president of Local 1496, Riverside, Calif., and David Ojeda, president of Local 1563, El Monte, Calif.

When the Teamsters initiated a representation drive on our members in Local 1496, who work for Laidlaw Transit in the Riverside area, Lonnie spent hours explaining to his membership the many benefits and advantages of UTU representation and solidarity.

David, a friend of Lonnie’s, volunteered to help and came to Riverside and gave to the members of Local 1496 the perspective of another local on how to work together and resolve internal issues.

This willingness and commitment to assist fellow officers and members, to help them identify, improve and advance their mutually beneficial goals for the betterment of all, is very important to labor-union members everywhere, and especially to those working for Laidlaw Transit.

It also forms the foundation of the UTU and its predecessor labor organizations; it is upon this foundation that the UTU has built 40 years of success.
