{"id":45265,"date":"2018-12-06T11:16:55","date_gmt":"2018-12-06T16:16:55","guid":{"rendered":"https:\/\/www.smart-union.org\/?p=45265"},"modified":"2018-12-06T11:16:55","modified_gmt":"2018-12-06T16:16:55","slug":"two-more-suits-added-against-csx-alleging-fmla-violations","status":"publish","type":"post","link":"https:\/\/www.smart-union.org\/two-more-suits-added-against-csx-alleging-fmla-violations\/","title":{"rendered":"Two more suits added against CSX alleging FMLA violations","gt_translate_keys":[{"key":"rendered","format":"text"}]},"content":{"rendered":"<p>According to the Jacksonville Business Journal, two more lawsuits were filed Nov. 29 alleging that CSX Corp. has violated employees&#8217; rights protected under the Family and Medical Leave Act (FMLA).<br \/>\nAccording to the <a href=\"https:\/\/www.dol.gov\/whd\/fmla\/fmla-faqs.htm#1\" target=\"_blank\" rel=\"noopener\">Department of Labor<\/a>, &#8220;FMLA provides eligible employees up to 12 workweeks of unpaid leave a year&#8230;and entitles employees to return to their same or equivalent job at the end of their leave.&#8221;<br \/>\nOne suit was filed by a former employee from West Virginia who alleges that she was fired for absenteeism while using approved FMLA time off to address migraines and recover from knee surgery, the Journal reported.<br \/>\nThe Journal said the other suit was filed in Ohio by an employee who states he&#8217;s been denied bonuses for good attendance because he took covered leave. This suit has been filed as a class-action suit, according to the Journal.<br \/>\nCSX has been accused by multiple others of having violated FMLA this year. <a href=\"http:\/\/www.herald-dispatch.com\/news\/former-workers-file-lawsuit-against-csx\/article_562d9397-6479-5bb7-ae39-9737521af490.html\" rel=\"noopener\" target=\"_blank\">In February, a suit was filed in West Virginia claiming that CSX fired 46 employees who were covered under FMLA<\/a>. <a href=\"https:\/\/www.bizjournals.com\/jacksonville\/news\/2018\/03\/13\/more-than-100-former-employees-sue-csx.html\">In March, a similar claim was made in Maryland after the railroad fired 20 more employees for the same reasons<\/a>. Three more suits filed this year in Alabama and Pennsylvania also allege the company violated rights covered under FMLA.<br \/>\n<a href=\"https:\/\/www.smart-union.org\/news\/consultation-being-offered-for-those-targeted-by-csx-fmla-investigations\/\" rel=\"noopener\" target=\"_blank\">Late last year, CSX investigated a number of employees for taking FMLA leave, leading to one of SMART TD&#8217;s Designated Legal Counsel to offer services.<\/a><\/p>\n","protected":false,"gt_translate_keys":[{"key":"rendered","format":"html"}]},"excerpt":{"rendered":"<p>According to the Jacksonville Business Journal, two more lawsuits were filed Nov. 29 alleging that CSX Corp. has violated employees&#8217; rights protected under the Family and Medical Leave Act (FMLA).
