{"id":37664,"date":"2015-03-10T09:43:21","date_gmt":"2015-03-10T13:43:21","guid":{"rendered":"http:\/\/smart-union.dev\/news\/amtrak-has-authority-to-set-on-time-performance\/"},"modified":"2015-03-10T09:43:21","modified_gmt":"2015-03-10T13:43:21","slug":"amtrak-has-authority-to-set-on-time-performance","status":"publish","type":"post","link":"https:\/\/www.smart-union.org\/amtrak-has-authority-to-set-on-time-performance\/","title":{"rendered":"Amtrak has authority to set on-time performance","gt_translate_keys":[{"key":"rendered","format":"text"}]},"content":{"rendered":"<p><em>The following release was issued by the\u00a0<em>Environmental Law &amp; Policy Center:<\/em><\/em><\/p>\n<p>WASHINGTON \u2013 The U.S. Supreme Court\u2019s March 9 decision<img decoding=\"async\" class=\"alignleft size-full wp-image-10785\" style=\"margin-top: 4px;margin-bottom: 4px;margin-left: 10px;margin-right: 10px\" alt=\"Amtrak Logo\" src=\"https:\/\/www.smart-union.org\/wp-content\/uploads\/2011\/06\/amtrak_w_shadow_150px.jpg\" width=\"150\" height=\"66\" \/> affirming Amtrak\u2019s power to create on-time performance standards could get slumping Midwest arrival times back on track.<\/p>\n<p>\u201cThis is a good Supreme Court decision that should help rail passengers across the country,\u201d said Howard Learner, Executive Director of the Environmental Law &amp; Policy Center, which filed an amicus curiae brief in the case. \u201cFor every passenger who has been delayed for hours in Northwest Indiana or outside of Cleveland while oil tanker cars slog by, today\u2019s court decision can be an important step forward.\u201d<\/p>\n<p>The Association of American Railroads challenged a federal law that allows Amtrak to help set on-time performance standards for railroads, arguing that Amtrak is a private company rather than a government entity. The Supreme Court, agreeing with the Department of Justice and ELPC, held that Amtrak is more like a government entity.<\/p>\n<p>The DC Court of Appeals had struck down a provision of the 2008 rail reauthorization bill that instructed the Federal Railroad Administration and Amtrak \u2013 consulting with the Surface Transportation Board, freight railroads, states, rail labor, and rail passenger organizations \u2013 to develop metrics and minimum standards for measuring Amtrak passenger train performance and service quality.<\/p>\n<p>\u201cToday\u2019s U.S. Supreme Court ruling settles that legal question,\u201d Learner said. \u201cAmtrak is a government entity. Given this ruling, the existing on-time performance standards should be enforced and passenger rail should again be given priority.\u201d<\/p>\n<p>In an amicus curiae brief filed by ELPC, on behalf of itself and the National Association of Railroad Passengers, All Aboard Ohio and Virginians for High Speed Rail, ELPC found that on-time arrival rates had suffered since the appeals court ruling. In 2012, Amtrak achieved a nationwide on-time performance rate of 83 percent.
